This Public Notice is to inform the community of the U. S. Army Corps of Engineers’ (USACE) intent to conduct the 2023 Five-Year Review (FYR) for the former Fort Miles Military Reservation (FMMR), a Formerly Used Defense Site (FUDS Project # C03DE006304). Specifically, the FYR will evaluate three Munitions Response Sites (MRS): MRS 7 -- Suspect 40-mm Disposal Area, MRS 8 - Posted Live Dud Area and MRS 9 - Rocket Ranges. FMMR became Cape Henlopen State Park in Lewes, Delaware, following Base Realignment and Closure.
The purpose of the FYR is to determine if the remedy selected in the Decision Document (DD) for each of the above listed sites is, and will continue to be, protective of human health and the environment. The Army is required to evaluate the protectiveness of these remedies at least every five years because the selected remedies leave hazardous substances, pollutants or contaminants remaining in the soil or groundwater at MRS 7, 8 and 9.
Work Previously Completed: USACE found, through the 2006 Remedial Investigation/Feasibility Study, that sufficient MEC (Munitions and Explosives of Concern) remained at FMMR, MRS 7, 8 and 9, to pose a low to moderate explosive safety risk. Because of this potential risk, the DD, signed December 19, 2007, called for the removal of all MEC able to be detected and the establishment of Land Use Controls to further reduce risk for MRS 7, 8 and 9. Soil is the only medium affected. The MEC removal work was completed in 2008 and the Land Use Controls remain in place.
