LEAD FEDERAL AGENCY:

The U.S. Army Corps of Engineers, as the lead federal agency, is responsible for all coordination pursuant to applicable federal authorities.

APPLICANT’S PROPOSED AVOIDANCE, MINIMIZATION, AND COMPENSATORY MITIGATION:

Steps were taken to ensure avoidance and minimization of impacts to waters of the United States to the maximum extent practicable. Previously the work was verified under the Maryland State Programmatic General Permit (MDSPGP-5) to remove an existing timber pier; to construct 917 linear feet of replacement bulkhead with approximately 230 cubic yards of clean earth backfill to extend no more than 1.5 feet channelward of the existing deteriorating bulkhead; to emplace 10 linear feet of stone revetment; and to construct a 5-foot wide by 19-foot long floating pier gangway connecting to an 8-foot wide by 36-foot long floating platform attached to 2 timber anchor piles; all to extend a maximum of 29 feet channelward of the approximate mean high water shoreline. The applicant requested additional scope of work to construct a 70-foot long by 24-foot wide concrete boat ramp to replace the existing boat ramp; and to construct an 8-foot wide by 80-foot long floating platform and 6-foot wide by 32-foot long floating finger pier platform with a 20-foot long by 5-foot wide modular kayak launch attached to 4 timber anchor piles; all to extend a maximum of 36 feet channelward of the approximate MHW shoreline.

The applicant proposes to avoid and minimize impacts by replacing the existing deteriorated bulkhead, boat ramp, and timber pier with similar structures/fill with a minor additional encroachment of approximately 7-feet channelward of MHW shoreline. The applicant does not propose compensatory mitigation for the since the applicant proposes to impact less than 5,000 square feet of waters of the United States.
