Application No. NAB-2022-00093-P02 (PA DOT – Fetter Advanced Wetland Compensation Site). 
The Baltimore District has received a request to modify the Pennsylvania Department of Transportation (PA DOT) Umbrella Mitigation Banking Instrument (PUMBI) approved on February 3, 2013, to add the existing Fetter Advanced Wetland Compensation Site, operated under an Interagency Agreement for Advanced Wetland Compensation approved in 1995 with PA DOT Engineering District 9-0. PA DOT requests that the Fetter Advanced Wetland Compensation site be added to the list of approved PUMBI mitigation banks and operated in accordance with the PUMBI, including monitoring protocol, long term management, crediting and debiting, service areas, and closure procedures outlined in the PUMBI.

WATERWAY AND LOCATION: The project is located in the Dunning Creek Watershed, off Mennonite Road in West St. Clair Township, Bedford County, Pennsylvania at coordinates 40.158214 N, -78.613114 W.
PROJECT PURPOSE: The purpose of this notice is to solicit comments on the mitigation site plan for amending the established Fetter Advanced Wetland Compensation Site to the PA DOT PUMBI as an approved wetland mitigation bank, managed under the PUMBI requirements and procedures.

EVALUATION: The Corps of Engineers is soliciting comments from the public; federal, state, and local agencies and officials; Indian Tribes; and other interested parties to help inform the Corps and the Interagency Review Team as to the overall merits of modifying the PUMBI to include the Fetter Advanced Wetland Compensation Site as an approved wetland mitigation bank, and to identify project aspects that should be addressed during the evaluation process of the mitigation site plan and proposed modification of the PUMBI. Any comments received will be considered by the Corps of Engineers to determine whether the proposal has the potential to provide mitigation opportunities for PA DOT projects authorized to impact waters of the U.S. under Section 404 of the Clean Water Act and/or Section 10 of the Rivers and Harbors Act, or as a means of resolving Section 404 and/or Section 10 enforcement actions, within the identified service area. Comments provided will become part of the public record for this action and are subject to release to the public through the Freedom of Information Act.
SUBMISSION OF COMMENTS: The Baltimore District will receive written comments on the proposed work, as outlined above, until April 13, 2025. Any person may request, in writing, within the comment period specified in this notice, that a public hearing be held to consider the application. Requests for public hearings shall state, with particularity, the reasons for holding a public hearing. Requests for a public hearing will be granted, unless the District Engineer determines that the issues raised are insubstantial or there is otherwise no valid interest to be served by a hearing.
